WITs, Inc. (“WITs”) operates a technology platform that connects employers with independent, credentialed First Aid Technicians for on-site treatment of first-aid-level workplace injuries. WITs is a dispatch and documentation platform; technicians are independent contractors, not employees or agents of WITs. Use of the platform constitutes acceptance of these terms.
The WITs platform is not a substitute for emergency medical services and must never be used for life-threatening conditions. The in-app triage questionnaire directs users with critical indicators to call 911 immediately, and you agree to follow that direction. WITs makes no guarantee of response time and does not provide emergency medical care.
Company accounts may be created only by authorized representatives of an eligible employer, and employee app accounts are provisioned by the employer. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Accounts may be suspended for misuse, misrepresentation, or non-payment.
Companies authorize WITs to charge their saved payment method upon approval of an aftercare report, at the flat rates and add-on prices disclosed at dispatch. Requests cancelled after a technician has accepted may incur a cancellation fee as disclosed in the app at the time of cancellation. All charges are processed by our payment provider; WITs does not store full card numbers.
Technicians must maintain current certifications, required insurance coverage, and a valid driver's license at all times while active on the platform, and must operate strictly within a first-aid scope of practice under applicable OSHA first aid guidelines. Falsified credentials result in immediate removal.
To the maximum extent permitted by law, WITs' aggregate liability arising out of the platform is limited to the amounts paid by you in the twelve months preceding the claim. WITs is not liable for the acts or omissions of independent technicians, except as required by applicable law.
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in San Diego County, California, and the parties consent to that venue.
